Notice periods in Brussels
Who can end the lease, when, with what notice and what indemnity.
- Notice counts from presumed receipt: the day a bailiff serves it, the day a registered letter is presented (or the acknowledgement signed), or the second day after an ordinary letter is posted.
- Notice that can be given at any time runs from the first day of the next month; notice for a term date runs from the day after receipt.
- 9-year lease: the tenant can leave at any time with three months’ notice. Leaving in the first three years costs 3, 2 or 1 month’s rent, depending on the year in which the lease ends.
- 9-year lease: the landlord gives notice six months before the term, or for own use, for major works (end of the 1st or 2nd three-year period) or without reason with an indemnity of 9 or 6 months’ rent.
- Short lease: notice three months before the end, otherwise it becomes a 9-year lease. The tenant can leave earlier with three months’ notice and one month’s indemnity.
- The Region publishes an official model letter for each situation.
